1. Acceptance of Terms & Service Scope

Welcome to Détour. These Terms of Service ("Terms") constitute a legally binding agreement between you and Détour Inc. ("Détour", "we", "us", or "our") governing your access to and use of the Détour mobile applications (iOS and Android), website (joindetour.me), and related services (collectively, the "Services").

By creating an account, downloading our mobile app, or accessing the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy and Child Safety Standards. If you do not agree to these Terms, you are not authorized to access or use the Services.

2. Mandatory 18+ Eligibility & Warranties

You may only create an account and use the Services if you satisfy all of the following eligibility requirements:

• You are at least 18 years of age (or the legal age of majority in your jurisdiction, whichever is greater).
• You are legally capable of entering into a binding contract with Détour Inc.
• You have never been convicted of a felony, sex offense, or any crime involving violence, harassment, or intimidation.
• You are not currently required to register as a sex offender with any local, state, federal, or international sex offender registry.
• You have not been previously banned or removed from the Détour platform for violations of our Terms or Safety Guidelines.
• You will comply with these Terms and all applicable local, state, national, and international laws, rules, and regulations.

3. Account Credentials & Security

To use Détour, you must register an account using a valid mobile phone number (verified via SMS OTP) or an authorized third-party authentication service (Apple Sign-In / Google Sign-In).

You agree to maintain the confidentiality of your login credentials and are solely responsible for all activities, content postings, and communications that occur under your account. You must notify us immediately at support@joindetour.me if you suspect any unauthorized access to your account.

You agree to create only one account for your personal use. You may not sell, rent, transfer, or assign your account to any third party.

4. User Content & License Grant

You retain full ownership of all original content you create and upload to Détour, including profile photos, bio copy, short-form video/photo "Vibes", Icebreaker prompt answers, and message content ("User Content").

You represent and warrant that your User Content does not infringe upon the copyrights, trademarks, privacy rights, publicity rights, or intellectual property of any third party.

5. Acceptable Use & Prohibited Conduct

Détour is built on respect, authenticity, and safety. You agree that you will NOT engage in any of the following prohibited behaviors:

• Explicit or Pornographic Content: Posting sexually explicit material, full or partial nudity, pornography, or graphic violence.
• Harassment & Hate Speech: Bullying, stalking, intimidating, defaming, or making hateful remarks targeting race, ethnicity, religion, gender, sexual orientation, disability, or age.
• Impersonation & Deception: Creating fake profiles, impersonating any person or entity, or catfishing.
• Commercial Exploitation & Spam: Utilizing the platform for commercial advertising, soliciting funds, multi-level marketing, or sending automated spam messages.
• Unlawful Solicitation & Trafficking: Promoting illegal acts, prostitution, escort services, financial scams, or human trafficking.
• Reverse Engineering & Scraping: Scraping, harvesting, data-mining, reverse engineering, or attempting to compromise app source code or API security infrastructure.
• Off-Platform Content Recording: Taking screenshots, screen recordings, or publicly sharing another user's private media, profile photos, or chats without explicit consent.

6. Consent-Based Interaction & Context-First Messaging

Détour introduces a context-first discovery model designed to eliminate spam and unsolicited messages.

You acknowledge and agree to the following interaction rules:

• Mutual Acceptance Requirement: Direct messaging channels only open when an interaction with a Vibe or Match Request is mutually accepted by both users.
• Respecting User Boundaries: If a user declines your match request or unmatches you, you must respect their decision. Attempting to circumvent unmatching or contacting the user on external platforms is strictly prohibited and constitutes harassment.

7. AI Assistant (Arlene) Disclosure

Détour features Arlene, an optional AI communication assistant designed to help suggest conversation openers, provide profile recommendations, and improve message drafts.

By using Arlene features, you acknowledge and agree to the following:

• Arlene suggestions are generated programmatically using artificial intelligence algorithms and are provided for informational and creative reference only.
• Arlene will NEVER auto-send a message or initiate contact on your behalf without your explicit manual review and approval.
• You remain 100% responsible for all final messages, responses, and profile content you choose to transmit on Détour.

8. Intellectual Property & Brand Ownership

Détour Inc. retains all rights, title, and interest in and to the Services, including all logos, software code, visual UI design, custom graphics, typography, interactive animations, trademarks, service marks, and trade secrets ("Détour IP").

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the mobile application solely for personal, non-commercial use in accordance with these Terms.

9. Safety Disclosures & Background Checks Disclaimer

YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS, BOTH ONLINE AND OFFLINE.

10. Account Suspension, Termination & Deletion

We reserve the right, at our sole discretion, to investigate, suspend, restrict, or permanently terminate your account without prior notice or refund if you breach these Terms, violate our Safety Guidelines, or engage in disruptive behavior.

Voluntary Account Deletion

You may terminate your account at any time by navigating to Profile → Settings → Account → Delete Account, or by emailing support@joindetour.me with the subject line "Delete my account". Account deletion is governed by our Privacy Policy retention procedures.

11. Disclaimers of Warranties & Limitation of Liability

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DÉTOUR INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL DÉTOUR INC.'S AGGREGATE LIABILITY EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID TO DÉTOUR INC. IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification & Binding Arbitration Waiver

You agree to defend, indemnify, and hold harmless Détour Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms or your User Content.

Binding Individual Arbitration & Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be settled by binding individual arbitration administered under the commercial rules of the American Arbitration Association (AAA). YOU AGREE THAT ALL CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

13. Governing Law & Legal Contact Information

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
